pic2The Fourth Appellate District, Division Three, has invalidated the provision of an automobile insurance policy excluding coverage for injuries sustained by unrelated cohabitants of the named insured. (Mercury Casualty Co. v. Chu (July 24, 2014) 2014 WL 4732889.) The named insured was at fault in an accident that injured his passenger, who was also his roommate. The policy defined insureds to include those who inhabited the same dwelling as the named insured. Acknowledging the validity of "relative resident" exclusions, the Court of Appeal held that the "nonrelative resident" exclusion was overbroad and contrary to public policy.

  The Life of a Trial Lawyer
GTA Educates Law Students on "The Life of a Trial Lawyer"

On September 18, 2014, Gomez Trial Attorneys invited current law students into the GTA courtroom to hear from John Gomez, Dave Fox, and Bibi Fell on what life is like as a plaintiff's trial lawyer. John talked about the benefits plaintiff's work provides to our clients and communities, addressed negative stereotypes, and gave the students a six minute sample closing argument from a real case. Dave talked about a couple of his cases, clients, and showed the students how he used visuals in real trials to explain how the situations that led to our client's injuries should have been made more safe to avoid injury. Bibi talked about the differences between having a plaintiff's practice and working at a large law firm and the case that initially drew her to plaintiff's work.

After the presentation, those in attendance mingled over dinner to talk with John, Dave, and Bibi about their personal experiences and aspirations. The talk was both well-attended and appreciated.

  National Association of Women Judges 36th Annual Conference
GTA Premier Sponsor of National Association of Women Judges 2014 Annual Convention

This year, Gomez Trial Attorneys is the Premier Sponsor of the National Association of Women Judges 36th Annual Conference from October 15th-19th. NAWJ is an association with the mission of promoting the judicial role in protecting the rights of individuals under the rule of law through strong, committed, diverse judicial leadership; fairness and equality in the courts; and equal access to justice. Each year, NAWJ hosts a conference for its members to come together and attend educational sessions, receptions, and other events. Keynote speaker highlights include Supreme Court Justice Sonia Sotomayor, current president of the University of California system Janet Napolitano, Professor Anita Hill and Professor Charles Ogletree. NAWJ's 2014 conference mission is "Protecting and Advancing Meaningful Access to Justice," and GTA couldn't be more excited to be part of that mission.

  2014 Women Trial Lawyers Retreat
1st Annual CASD Women Trial Lawyers Retreat

On September 19-21, 2014, the CASD women caucus arranged a unique educational experience that allowed women trial lawyers to gather in one place to learn, connect, and create. One of our own trial lawyers, Parisima Roshanzamir, attended the event. The 1st Annual CASD Women Trial Lawyers Retreat took place in the beautiful Hyatt Regency Indian Wells resort in Palm Springs, California. Trial lawyers from all over the state, including San Diego, Santa Ana, Irvine, Orange, Palm Springs, San Francisco and Burlingame gathered in one place to spend a weekend together and develop meaningful professional relationships.

The first of its kind in the United States, the retreat offered educational programs with MCLE credits that included top favorites like how to develop one's own personal branding, partnerships, and case collaborations. Trial lawyers shared their experiences both in and out of the courtroom in an open forum creating a unique opportunity to inspire. The highlight of the program, however, was an afternoon day spa that allowed the trial lawyers to choose between mani-pedi, facial, or full body massage. A full afternoon of spa delight was followed by a memorable art exhibition led by Deborah Wolf, twice named CASD Trial Lawyer of the Year and recipient of four Outstanding Trial Lawyer Awards.

Ben Coughlan


Ben is a trial attorney devoted entirely to representing individuals who have suffered catastrophic personal injuries. He has worked extensively on issues involving traumatic brain injuries, automobile accidents and dangerous premises. Ben believes strongly in giving his clients the personal attention necessary to achieve the justice they deserve.

In 2013, Ben was named one of the Top 10 Personal Injury Attorneys in San Diego by the San Diego Daily Transcript. He was also named one of San Diego County's "Top Young Attorneys" by the same publication. Ben was selected in 2013 to attend the prestigious TIPS/ABOTA National Trial Academy, where he received top marks in scoring for both his cross-examination and closing argument by the Honorable Janet Berry of the Second Judicial District Court.

Jackie Smith

Jacqueline began working for Gomez Trial Attorneys in February 2013, as we transitioned into their new office space. Although she had not been exposed to the legal field prior to this position, she has met her role in the company with a strong work ethic, team player attitude and enthusiasm for the job.

Jacqueline is a San Diego State Alumni; she graduated in 2010 with her Bachelor of Arts in Psychology.

In addition to her love of writing, photography, and spending time with close friends, she is also a fitness enthusiast and is working towards her certification in personal training. In her spare time Jacqueline enjoys being active and participating in her new favorite activity, paddle boarding.
